2. Services Provided

Omanext offers trademark registration services in France and Europe, including legal research and filings by qualified attorneys.

3. Trademark Verification ("Free Lawyer's Check")

The free verification includes an assessment of the registrability of your trademark and a search for identical or confusingly similar trademarks in the relevant registers. This service evaluates the likelihood of successful registration. Some databases may not be updated in real-time, and unless requested, no re-verification will occur before filing. Omanext cannot be held liable for database outages from Intellectual Property offices.

Verifications are prepared by trademark professionals aiming to identify potential obstacles to registration. However, no guarantee is provided against oppositions or future conflicts. Omanext is not responsible for bad faith filings or misuse by the client, and no refunds are available in such cases.

4. Drafting

Drafting involves preparing the trademark application based on your specifications. You may modify your order before final submission. For major changes, such as transferring fees to a new application, you must notify Omanext.

Before filing, you will receive an Application Summary for your confirmation. Final approval is required to proceed. Please monitor your email, as inactivity will place your filing on hold. Responsibility lies with you to contact Omanext if no email is received.

5. Filing & Representation

Filing refers to submitting your trademark application to the relevant office. Omanext ensures submission as instructed but does not guarantee approval or registration. Some jurisdictions may involve local legal partners for compliance.

Fees cover filing only. Representation during oppositions, disputes, or litigation is not included. Upon payment, you will receive a Power of Attorney to complete. Delays in returning the signed document may postpone filing.

6. Refund Policy

If your trademark is marked as “No risk” and is later refused or opposed, you may receive a full refund of the service fee (excluding official fees), depending on the service stage.
Before Drafting: Full refund.
After Drafting: Only official fees refunded.
After Filing: No refund available.
Withdrawals post-filing are subject to processing fees.

7. Pricing and Payment

All prices include administrative fees. Payment is required upfront before services are rendered. Prices vary based on jurisdiction and the number of classes. Additional classes are subject to extra charges.

8. Liability

Omanext provides its services on a best-effort basis, using qualified professionals. However, Omanext is not liable for indirect damages, including loss of opportunity, revenue, or issues arising from external data sources or third-party databases.

9. Intellectual Property

All documents, tools, and methods provided remain the intellectual property of Omanext. Use is restricted to internal purposes unless otherwise agreed.

10. Confidentiality

Both parties agree to maintain confidentiality over exchanged information during and after the services, except when legally required to disclose.

11. Governing Law

These Terms and Conditions are governed by French law. In case of disputes, the competent jurisdiction will be the courts of Paris, France.
